1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Xonoko Budget ("Xonoko," "we," "us," or "our") governing your access to and use of our budgeting application, website, and related services (collectively, the "Services").
By creating an account, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.
If you are using the Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility
To use our Services, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Services under applicable law
- Reside in a country where the Services are available
3. Description of Services
Xonoko Budget is a personal finance management application that provides:
- Bank Account Connection: Secure, read-only connections to your financial institutions through certified third-party data aggregators
- Transaction Tracking: Automatic import and categorization of your transactions
- Budget Management: Tools to create and track spending budgets by category
- Project-Based Savings: Goal-setting features for specific savings objectives
- AI-Powered Features: Automatic categorization, spending predictions, and personalized suggestions
- Multi-Platform Access: Web, iOS, and Android applications
Read-Only Access: Our Services access your financial data in read-only mode. We cannot initiate transactions, transfer funds, or make any changes to your bank accounts.
4. Account Registration and Security
4.1 Account Creation
To use most features of our Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Update your information to keep it accurate and current
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
4.2 Account Security
You are responsible for maintaining the security of your account. We recommend using a strong, unique password and enabling two-factor authentication when available. We are not liable for any loss or damage arising from your failure to protect your account credentials.
5. Subscription Plans and Payment
5.1 Subscription Tiers
We offer the following subscription plans:

Current pricing is displayed in the app and on our website. Prices may vary by region and are shown in your local currency.
5.2 Free Trial
New users may be eligible for a 14-day free trial. During the trial, you have access to all features of the selected plan. At the end of the trial period, your subscription will automatically begin and you will be charged unless you cancel before the trial ends. We reserve the right to modify or discontinue free trials at any time.
5.3 Payment Terms
- Subscriptions are billed monthly on a recurring basis
- Payment is processed through RevenueCat and platform-specific payment processors (Apple App Store, Google Play, Stripe)
- By subscribing, you authorize us to charge your payment method on a recurring basis
- You are responsible for all applicable taxes
- All fees are non-refundable except as expressly set forth in these Terms or as required by law
5.4 Price Changes
We may change subscription prices from time to time. Price changes will take effect at the start of the next billing period following notice to you. If you do not agree to a price change, you may cancel your subscription before it takes effect.
5.5 Cancellation
- You may cancel your subscription at any time through the app settings or your app store account
- Cancellation takes effect at the end of the current billing period
- You will retain access to paid features until the end of your current billing period
- We do not provide prorated refunds for partial billing periods
5.6 Refunds
Refunds are handled according to the policies of the platform where you made your purchase (Apple App Store, Google Play, or direct). For EU consumers, you have the right to withdraw from a purchase within 14 days, subject to applicable exceptions for digital content.
6. Bank Account Connections
6.1 Authorization
By connecting your bank accounts through our Services, you:
- Authorize us to access your account information through our certified third-party data aggregation partners
- Confirm that you have the right to grant such access
- Understand that we access data in read-only mode and cannot initiate transactions
- Acknowledge that we do not store your bank login credentials
6.2 Third-Party Aggregators
Bank connections are facilitated through third-party data aggregation services (such as Plaid and Tink). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or security of data provided by these third parties.
6.3 Connection Availability
We do not guarantee that connections will be available for all financial institutions. Connections may be temporarily or permanently unavailable due to technical issues, changes by your financial institution, or other factors outside our control.
6.4 Disconnection
You may disconnect any bank account at any time through the app settings. We will stop receiving new data from disconnected accounts, though previously imported data will remain unless you delete it.
7. User Conduct and Acceptable Use
You agree not to:
- Violate any applicable law, regulation, or third-party rights
- Use the Services for any fraudulent or illegal purpose
- Provide false or misleading information
- Access accounts or data belonging to others without authorization
- Attempt to gain unauthorized access to our systems or networks
- Interfere with or disrupt the Services or servers
- Use automated means (bots, scrapers, etc.) to access the Services without permission
- Reverse engineer, decompile, or attempt to extract source code
- Remove, alter, or obscure any proprietary notices
- Use the Services to transmit malware or malicious code
- Harass, abuse, or harm others
- Resell, sublicense, or commercially exploit the Services without authorization
8. Intellectual Property
8.1 Our Intellectual Property
The Services, including all content, features, functionality, software, text, graphics, logos, and trademarks, are owned by Xonoko Budget and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.
8.2 Your License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.
8.3 Your Data
You retain ownership of your personal data and any content you create within the Services (such as budget names, notes, and categories). By using our Services, you grant us a limited license to use this data solely to provide, maintain, and improve the Services.
8.4 Feedback
If you provide feedback, suggestions, or ideas about our Services, you grant us the right to use such feedback without restriction or compensation to you.
9. Disclaimers
9.1 "As Is" Provision
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9.2 No Financial Advice
XONOKO BUDGET IS NOT A FINANCIAL ADVISOR, INVESTMENT ADVISOR, TAX ADVISOR, OR LEGAL ADVISOR. The Services provide tools and information to help you manage your personal finances, but do not constitute financial, investment, tax, or legal advice. Any decisions you make based on information from the Services are your sole responsibility. You should consult qualified professionals for specific advice.
9.3 Data Accuracy
We do not warrant that the financial data displayed in the Services is accurate, complete, or current. Data from connected accounts depends on third-party aggregators and your financial institutions. You should verify important financial information directly with your institutions.
9.4 Service Availability
We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at any particular time or location. We may suspend or discontinue the Services at any time without notice.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- XONOKO BUDGET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €100.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Xonoko Budget and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of applicable laws
12. Termination
12.1 Termination by You
You may terminate your account at any time by deleting your account through the app settings or by contacting us at support@xonoko.com.
12.2 Termination by Us
We may suspend or terminate your account and access to the Services at any time, with or without cause, with or without notice. Reasons for termination may include:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment of subscription fees
- Extended periods of inactivity
- Requests by law enforcement or government agencies
- Discontinuation of the Services
12.3 Effect of Termination
Upon termination:
- Your right to use the Services immediately ceases
- We may delete your data after a reasonable retention period (typically 30 days)
- Provisions that by their nature should survive termination will remain in effect
13. Dispute Resolution
13.1 For European Union Users
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France, without prejudice to any mandatory consumer protection rights under the laws of your country of residence.
You may also be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
13.2 For United States Users
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Arbitration Agreement: You and Xonoko Budget agree to resolve any disputes through binding individual arbitration rather than in court, except for disputes that qualify for small claims court. This means you waive your right to a jury trial and to participate in class actions.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@xonoko.com within 30 days of creating your account.
13.3 For Users in Other Jurisdictions
These Terms are governed by the laws of France. Disputes shall be resolved in the courts of Paris, France, unless your local law requires otherwise.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website with a new "Last Updated" date
- Sending an email notification for significant changes
- Displaying a notice in the app
Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services and cancel your subscription.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Xonoko Budget regarding the Services and supersede all prior agreements.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
15.5 Notices
We may provide notices to you via email, in-app notifications, or posting on our website. You may provide notices to us at legal@xonoko.com.
15.6 Force Majeure
We shall not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet service disruptions.
